Most records in Barry County's 5th Circuit Court are public. The Register of Actions for each case is open for inspection. Civil, criminal, and family case dockets can be viewed by anyone during court business hours. Public access to court records in Michigan is governed by MCR 8.119, which sets out what courts must provide and how they protect sensitive personal information in documents they release.
Some records are not public. Juvenile cases are confidential under MCL 600.1750. Personal Protection Order cases are not searchable online under MCR 3.705. Cases handled under the Holmes Youthful Trainee Act are sealed. First-time drug offense dispositions under MCL 333.7411 are restricted from online public access. Courts in Michigan also follow the Michigan Clean Slate Law. This 2020 law allows for automatic expungement of certain convictions. As expungements are processed, some criminal records may be removed from public access in Barry County's circuit court. If you are searching for a specific criminal case and cannot find it, the Clean Slate Law may be why it no longer appears online.
